A Primer on Patents

Everything you needed to know about patents but were afraid to ask…

By Pin Tan, Patent Attorney and Managing Partner of Lightbulb IP

Protection for New and Useful Inventions

Patents provide broad protection over inventions or discoveries that are both new and useful by giving patent holders the exclusive right to make, use, sell, or offer to sell their patented inventions. This means a patent holder can exclude third parties from making, using, or selling his or her patented invention. Unlike other forms of intellectual property protection, a patent holder’s exclusive rights extend to third parties who independently develop or discover the invention.

Types of Patents and Patent Applications

There are three types of patents and patent applications, namely, utility, design, and plant patents. Utility patents protect the way

Kate – Boxer/Pit Mix Needs a Home by FRIDAY!

Kate’s owner is relocating and has to take her to the shelter unless she gets a home within two weeks – please help!

“This is Kate. I originally called her Kate Plus 8 – when I first fostered her mid-May she came to me with 8 newborn pups. Now all her pups have found homes and I have spent the last 3 months socializing her and showing her what love is.

She is a 18 month old Boxer/pit mix. She loves nothing more than snuggling and hanging out by your side. Fetching a tennis ball is her newest obsession, and will sleep with the ball. She gets along with other dogs well. Walking her was initially hard because she pulls, bit I got her a Halti harness and she is

Sweet Scared Pitbull Needs Foster Home NOW

This guy is in Las Vegas, Nevada and is in desperate need of a foster home.

From a friend’s e-mail: ”This sweet scared boy is still at the Henderson shelter and some staff there have not been the most cooperative when people have brought their dogs to meet him. Seems to be some pitbull prejudice there! They have even taken him off their website although he is still there. And now they are saying he needs to go to a home where he’s the only dog even though he came in with a little Chihuahua friend. Sadly they don’t take into consideration the fear and stress this poor guy is feeling and how meeting another dog under those circumstances can cause him to act atypically.

His only hope now

What to Expect from an Initial Consultation

There seems to be a significant difference between what lawyers have been taught to provide and what potential clients expect to get from an initial consultation.  I blame those TV commercials that suggest lawyers can and will solve all your problems in one meeting.  No lawyer can do that and if any lawyer tells you otherwise, call someone else.

An initial consultation serves three basic purposes: 1) for the lawyer to determine whether he or she can represent the potential client, 2) for the lawyer and potential client to determine whether they want to work together, and 3) for the lawyer to explain how the representation will proceed if the potential client decides to retain the lawyer.

A lawyer cannot represent every person who calls.  Lawyers are required to follow

My First Blog

When preparing to write this, my first-ever blog article, I was struck with a serious case of writer’s block. While staring at a blank screen, I was overcome with questions. What should I discuss? Who is my audience? Does anyone even care what I have to say? Realizing that overanalysis equals paralysis, and that if I wait to come up with the perfect topic this page will remain forever blank, I’ve decided that for my first-ever article, I will just write SOMETHING. Like ripping off a Band-Aid, I will write, I will post, and I will walk away. And the world won’t implode just because I didn’t come up with something profound. (Did it work?)
